Subscriber Terms and Conditions

THESE TERMS  

  • What these terms cover. These are the terms and conditions on which we supply Subscription Services to you. Your application to register an account and your continued use of our services will constitute your acceptance of these Terms, and your acceptance to comply with our Website Terms of Use, Privacy Policy, Cookies Policy, and any Antstream Rules.

  • Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide Subscription Services to you, how you and we may change or end your Subscription, what to do if there is a problem and other important information. 

 

INFORMATION ABOUT US AND HOW TO CONTACT US  

  • Who we are. We are Antstream Limited a company registered in England and Wales and our registered office is at 124 City Road, London, EC1V 2NX.

  • How to contact us. You can contact us by emailing our customer service team at support@antstream.com.

  • How we may contact you. If we have to contact you we will do so by writing to you at the email address or postal address you provided to us in your order.

OUR CONTRACT WITH YOU

SUBSCRIPTIONS PROCESSED DIRECTLY WITH ANTSTREAM

These are subscription processed via our website or application, that do not take you out to a 3rd party store (e.g. Amazon, Google, Xbox).

  • How we will accept your order (“Subscription”) for our services (“Subscription Services”). Our acceptance of your order will take place when you have selected a subscription tier and paid your Subscription Fee, at which point a contract will come into existence between you and us.

  • If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for Subscription Services.

  • Your unique reference. When you sign up directly we will use the email address you provide as your unique ID, please quote this when communicating with us.

  • Geographic Availability.  Subscription Services are broadly available within Europe, North America, some regions of South America and Australia.  There is limited support in Asia currently.  If you purchase service in a region that is not well supported, and we are not able to provide a good service, we will provide a refund of the Subscription Fee.

  • Your Antstream Account. As part of the registration process you shall be required to provide your email address and create a username and password for your Account ("Login Details"). You are responsible for the security of your Login Details and we are not liable for any unauthorised access to your Account arising from your failure to keep your Login Details secure. We may, in our sole discretion, reject or change your Login Details at any time and shall notify you in the event that such changes are applied. You are advised to refer to our Antstream Rules in relation to the creation of usernames.

    • You shall not provide access to your Account to any other person. If you suspect that your Account has been accessed by another person, you must notify us immediately via email to support@antstream.com.

  • Keeping your details updated.  From time to time we offer incentives and benefits for Antstream Subscribers. Antstream will use your email address for communication of such offers.  You are therefore responsible for letting us know if you change email addresses in order to receive details of such offers or receive any benefits. Antstream shall not be liable for your failure to keep your email details up to date which may result in your inability to participate or benefit from any such offers or receive any benefit.

ACCESS & DELIVERY OF SERVICES  

  • During the order process we will let you know how to access our services and how you can end your Subscription. We will make our Subscription Services available to you as soon as we accept your order.   We will supply the services to you until your Subscription expires or we or you end your Subscription as described below.

  • The customer provides express permission to deliver the Subscription Services by their choice to use of these services.

  • We are not responsible for delays outside our control. If our supply of Subscription Services is delayed by an event outside our control then we will contact you as soon as possible to let you know, and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end your Subscription and receive a refund for any Subscription Services you have paid for but not received.

  • What will happen if you do not give the required information to us. We may need certain information from you so that we can supply Subscription Services to you. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end your Subscription. We will not be responsible for supplying Subscription Services late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

  • Reasons we may suspend the supply of Subscription Services to you. We may have to suspend the supply of Subscription Services to: (a)  deal with technical problems or make minor technical changes; (b)  update Subscription Services to reflect changes in relevant laws and regulatory requirements. 

  • Your rights if we suspend the supply of Subscription Services. We will contact you in advance to tell you we will be suspending supply of Subscription Services, unless the problem is urgent or an emergency. If we have to suspend Subscription Services for an extended period we will adjust the price, or offer some other form of compensation to cover this interruption to service.  For any planned outage we will communicate this in advanced either using the email address you provided, or within the application, or both.

  • We may also suspend supply of Subscription Services if you do not pay. If you do not pay us for Subscription Services when you are supposed to and you still do not make payment within 2 days of us reminding you that payment is due, we may suspend supply of Subscription Services until you have paid us the outstanding amounts. We will always endeavour to communicate this with you.

YOUR RIGHTS TO MAKE CHANGES TO YOUR SUBSCRIPTION  

If you wish to make a change to your Subscription please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of Subscription Services or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.  Any such requests should be made via email to support@antstream.com.

 

YOUR RIGHTS TO END YOUR SUBSCRIPTION  

  • You can end your contract with us. Your rights when you end your Subscription will depend on what you have bought, whether there is anything wrong with it, how we are performing, and when you decide to end your Subscription.

  • Ending your Subscription because of something we have done or are going to do. If you are ending a contract for a reason set out in points 1 to 3 below your Subscription will end immediately and we will refund you in full for any Subscription Services which have not been provided and you may also be entitled to compensation. The reasons are:

  1. we have told you about an error in the price or description of Subscription Services you have ordered and you do not wish to proceed;

  2. we have suspended supply of Subscription Services for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 30 days; or

  3. you have a legal right to end your Subscription because of something we have done wrong.

  • Exercising your right to change your mind if you are a consumer (Consumer Contracts Regulations 2013). If you are a consumer then for most Subscription Services bought online you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms. If you have already started to access Subscription Services during this time, you will be charged for this use.

  • When you do not have a right to change your mind. Your right as a consumer to change your mind does not apply in respect of any digital Subscription Services after you have used them. If you cancel after you have started to use Subscription Services, you must pay us for the services provided up until the time you tell us that you have changed your mind. A contract for goods or digital content is completed when Subscription Services is delivered, downloaded or streamed and paid for. 

  • Terminating services early. If you want to end a contract before the end of its term and after 14 days, just contact us to let us know. We will switch off recurring billing, and your Subscription will end at the end of the current term based on your subscription.

 

HOW TO END YOUR SUBSCRIPTION WITH US

  • To end your Subscription with us, please let us know by doing one of the following:

  • Please provide your name, email address, and gamer tag (display name) when contacting us.

  • Your license to use our Subscription Services terminates upon the termination of your Subscription and you must make no further use of our software.

  • We will make any refunds due to you as soon as possible within 14 days.

OUR RIGHTS TO END YOUR SUBSCRIPTION  

We may end your Subscription for Subscription Services at any time if:

  1. you do not make any payment to us when it is due and you still do not make payment within 2 days of us reminding you that payment is due;

  2. you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide Subscription Services;

  3. you breach our EULA or any other terms we have with you including our Antstream Rules. 

SUBSCRIPTIONS VIA OTHER STORES

  • When you sign up via another store (e.g. Amazon, Google, Epic, Xbox) your Subscription is with them and you must abide by their terms of service as advertised by them.

  • Any changes to the subscription such as termination or refund must be processed via them following their terms.

  • Antstream has agreements in place with these stores to provide access to Subscription Services whilst there is an active (paid) Subscription.

TYPES OF SUBSCRIPTION

 

  • Regular subscriptions.  Regular subscription are available universally across direct channels and via our partners.  These consist of either a monthly or annual subscriptions where Subscription Fees are paid either monthly or annually to maintain access to the Subscription Services.  Whilst these Subscriptions are maintained (paid) they retain access to the version of Antstream that was subscribed to during the initial order.

  • Lifetime subscriptions.  This is a special offer with some of our partners that provides lifetime access to Subscription Services for a one time payment.  The subscriber will retain ongoing access to the version of Antstream that was subscribed to during the initial order.

    • These should be considered promotions, and such offers may been withdrawn at any time.​

  • In the event that a new version of the Antstream​ Subscription Services is launched with additional premium features, access to the newer features will not be automatically available to those with existing subscriptions.  Access to these new features can be provided by;

    • Purchasing a new subscription.​  This is available to anyone at any time.  Those with lifetime subscriptions wanting access to the newer features will need to purchase a new subscription package.

    • Upgrading an existing regular subscription.  Those paying a regular subscription can upgrade (increase their payment) to the new subscription level to gain access to the newer features.

CHANGES TO SUBSCRIPTION SERVICES

The content available through our services may vary from either the images or information provided to you. We reserve the right to remove any content from our services at any time without liability to you. We will notify you of any significant changes to the service.  

OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU 

  • We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time your Subscription was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

  • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation. 

  • When we are liable for damage caused by defective digital content. If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill we will either repair the damage or pay you compensation. However, we will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge or for damage which was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

HOW WE MAY USE YOUR PERSONAL INFORMATION  

How we will use your personal information. We will only use your personal information as set out in our privacy policy.

OTHER IMPORTANT TERMS  

  • We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will contact you to let you know if we plan to do this.  

  • Nobody else has any rights under this contract (except someone you pass your guarantee on to). This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end your Subscription or make any changes to these terms. 

  • If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If

  • any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

  • Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide Subscription Services, we can still require you to make the payment at a later date.

  • Which laws apply to this contract and where you may bring legal proceedings if you are a consumer. These terms are governed by English law and you can bring legal proceedings in respect of Subscription Services in the English courts. If you live in Scotland you can bring legal proceedings in respect of Subscription Services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of Subscription Services in either the Northern Irish or the English courts.
